There is no purchase necessary to enter or win the Family Energy 2004-2005 Sweepstakes Drawings.
The Family Energy 2004-2005 Sweepstakes Drawings are held between 12:01 AM CST December 1, 2004 and 11:59 PM CST, December 29, 2005 (the “Sweepstakes Period”). One separate "Monthly Prize Drawing" is held every 30 days during the Sweepstakes Period. The month is defined as 12:01 AM CST on the first day of the month until 11:59 PM CST on the last day of the month.
Entries received by Family Energy LLC, from all eligible participants during a given month will be entered into a Monthly Prize Drawing to be held with respect to that month only. Participants will not be eligible for re-entry in any subsequent Monthly Prize Drawings held during the Sweepstakes Period.
How to Enter the Sweepstakes:
If you subscribe to Family Energy magazine, you will automatically be entered in the Monthly Prize Drawing for the month in which you subscribe. The specific sweepstakes prize you will be eligible to win will be identified in the particular promotional magazine offer to which you respond.
Even if you choose not to subscribe to Family Energy you may still enter the Monthly Prize Drawing for that month and for the advertised prize by completing the online prize drawing entry form.
Purchasing a magazine subscription does not increase your chances of winning. You may be asked to indicate whether you wish to receive future e-mail promotions. However, you need not indicate your desire to receive these future promotions to be eligible for a Monthly Prize Drawing, nor will so doing affect your chances of winning.
Sweepstakes Limitations:
A maximum of five total entries per person per month. Additional entries will be disqualified.
Automated entries made using any script, macro, sweepstakes service or facsimiles will not be accepted.
Participants whose entries are selected may be requested to provide proof that they are the authorized account holder of the e-mail address associated with the selected entry.
Participants must provide complete and accurate information on the online order or prize drawing entry form to be eligible. P.O. boxes will not be accepted as valid postal addresses.
Participants whose entries are selected must confirm their mailing address by responding as instructed electronically to the communication from Family Energy LLC notifying them that their entry has been selected and that they are a potential winner.
Monthly Sweepstakes Prize Awards Procedures:
Each month, a total of one (1) prize winner will be selected by random drawing from among all eligible entries cumulatively received by Family Energy LLC during that month.
The odds of winning for each eligible entry depends on the number of other eligible entries submitted that month. Accordingly, the odds of winning a Monthly Prize Drawing will vary.
Prize winners are selected under the supervision of Family Energy LLC, whose decisions are final on all matters relating to each Monthly Prize Drawing. Winners will be notified by U.S. mail or e-mail. No substitution, transfer or assignment of prizes by the winner is permitted. If a prize notification or a prize is returned as undeliverable or if a participant whose entry has been selected fails to provide requested proof that such participant is the authorized account holder of the e-mail address associated with the selected entry or fails to confirm such participant’s mailing address, the prize will be forfeited and Family Energy LLC, may at its sole discretion, award that prize to an alternate winner or not award it at all. Limit: one prize per person, family or household per each Monthly Prize Drawing.
In the event any prize is discontinued or otherwise unavailable, Family Energy LLC reserves the right to deliver in lieu thereof a prize, gift certificate or cash of equal or greater value. All taxes on prizes are the sole responsibility of the winners. All entries become the property of Family Energy LLC and will not be acknowledged or returned.
No responsibility is assumed for lost, late or misdirected entries, for technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission or any human error that may occur in the receipt or processing of the entries in any Monthly Prize Drawing.
The Monthly Prize Drawings are open only to legal residents of the continental United States, who are age 18 years or older at time of entry. Void in the State of Rhode Island and void wherever restricted or prohibited by law. Entries received from persons residing in geographic areas in which entry is not permissible will be disqualified.
Employees of Family Energy LLC and their respective immediate family members (defined as spouse, child, sibling, parent or grandparent) and persons living in the same household of each are not eligible. All applicable laws and regulations apply.
If for any reason any Monthly Prize Drawing is not capable of running as planned, including infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Family Energy LLC that corrupt and affect the administration, secrecy, fairness, integrity or proper conduct of such Monthly Prize Drawing, Family Energy LLC reserves the right, at its sole discretion, to cancel, terminate, modify or suspend such Monthly Prize Drawing and/or disqualify any individual who tampers with the entry process. In the event of a dispute regarding online entry, the entry will be deemed submitted by the authorized holder of the e-mail account submitted at the time of entry. Authorized account holder is defined as the person who is assigned to an e-mail address by the Internet access provider, online service provider or other organization that is responsible for arranging e-mail addresses for the domain associated with the submitted e-mail address. Family Energy LLC does not assume any responsibility for any computer injury or damage related to or resulting from accessing and/or downloading any Monthly Prize Drawing material.
By participating in any Monthly Prize Drawing, each entrant agrees to release and hold Family Energy LLC, its respective parent companies, affiliates, subsidiaries, directors, officers, agents, contractors, employees and assigns, harmless against any and all claims, demands, damages, losses or liabilities of any nature whatsoever, including but not limited to, any harm or loss of any nature whatsoever, caused by, contributed to, arising out of or related to such Monthly Prize Drawings and the winning, redemption or use of any prize and entrant assumes all liabilities for the same. By participating in any Monthly Prize Drawing and/or by acceptance of any prize, entrants agree to be bound by the Official Rules and the decisions of Family Energy LLC.
The Family Energy 2004-2005 Sweepstakes Drawings are conducted in English and any and all disputes will be resolved in the appropriate courts in the State of Illinois, exclusively, and subject to the laws of the State of Illinois. Should there be conflict between the laws of the State of Illinois and any other laws, the conflict will be resolved in favor of the laws of the State of Illinois. If any part of these Official Rules shall for any reason be declared invalid or unenforceable by any final judgment of a court of competent jurisdiction or arbitration panel, such provision or provisions shall be reformed to approximate as nearly as possible the intent of the parties, and the validity of the remaining portions shall not be affected thereby to the maximum extent permitted by law.
Family Energy LLC, its affiliates, parent companies, subsidiaries, franchises, contractors and agents are not responsible for errors in the presentation of the Family Energy 2004-2005 Sweepstakes Drawings. Rules are subject to any requirements/limitations imposed by the U. S. Federal Trade Commission. Submission of entry and/or acceptance of a prize constitutes acceptance of these Official Rules, and permission for Family Energy LLC and its representatives and agents to print, publish, broadcast and use in any media winners' names, voices, photographs and/or likeness without compensation for purposes of advertising and promotional use, including releasing a list of winners' names and addresses to interested parties, unless prohibited by law.
For a list of winners’ names and addresses, available thirty (30) days after the conclusion of each Monthly Prize Drawing and for a period of six (6) months thereafter, send a separate, stamped, self-addressed #10 business-size envelope to: Family Energy Prize Drawing Winners, One Rotary Center, 1560 Sherman Ave., Suite 850, Evanston, IL 60201.
